Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant. Entry is only open to Australian residents aged 18 years of age and over who hold a valid driver’s licence in Australia. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Promotion commences at 00.01 am (Sydney time) on 02/11/2009 and ends at 11.59 pm (Sydney time) on 30/11/2009. To enter, participants must, during the promotion period, complete the online entry details at HYPERLINK “http://www.youtube.com/user/Blunty3000” http://www.youtube.com/user/Blunty3000 including, in 25 words or less, their answer to the question: ‘What makes the Yaris so clever?’. Maximum one entry per person. The Promoter accepts no responsibility for late, lost or misdirected entries. Incorrect, incomplete or incomprehensible entries will be ineligible to enter. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry that is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. The judging of all entries will take place at 2.00pm (Sydney time) on 2/12/2009 at HotHouse Interactive Pty Ltd, Level 3, 154 Pacific Highway, St Leonards NSW 2067. The Promoter’s decision is final and no correspondence will be entered into. The entry considered the most skilful and creative of all entries received, by the panel of judges, will be the winner. The winning entrant will receive a base model Toyota Yaris motor vehicle valued at $23,990 (Recommended Drive Away Price including GST, dealer delivery, stamp duty and on-road costs (comprising of 12 months registration and CTP only). Price will vary state to state and will depend upon the winner’s residential address. The winner may choose the colour of the prize car, subject to availability. Optional extras and anything not included in the prize will be at the winner’s own cost. The Yaris motor vehicle used for filming will not be the car won by the winner. All ancillary costs or accessories not expressly provided are the responsibility of the winner. Prize excludes comprehensive insurance which is the responsibility of each winner. Winner must collect their vehicles from the Toyota Dealership nearest their residential address. Travel to the Toyota Dealership to collect the prize is the responsibility of the winner. Collection of the vehicle is subject to availability of the vehicle and waiting time may be up to twelve weeks from the date of the judging. In the event that the prize vehicle becomes unavailable due to circumstances beyond the Promoter’s control, the Promoter reserves the right to provide an alternative vehicle to the same value as the original prize, subject to any applicable laws or written directions made under applicable State or Territory legislation. The Promoter accepts no responsibility for any variation in any prize value. Prize value is correct at 27/10/2009. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Prize is not transferable or exchangeable and cannot be taken as cash. Prize must be taken as offered and cannot be varied. The Promoter may conduct such further judging at the same time and place as the original judging as necessary on 01/03/2010 in order to distribute any prize unclaimed by that date subject however to any written directions given under State and Territory legislation. In the event of any winner in an unclaimed judging, the winner will be notified by telephone, in writing and their name and suburb will be published in The Australian newspaper on 08/03/2010. The Promoter reserves the right to request the winner to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm each winner’s identity, age, residential address, email address, drivers licence status, eligibility to enter and claim a prize and any information submitted by the winner in entering the promotion, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, that winner’s entry will become invalid. The prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion. The Promoter and its related bodies corporate, their officers, employees and agents shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained as a result of taking or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). The Promoter and its related bodies corporate make no warranties and accept no liability in relation to the vehicle, its condition or fitness for any purpose. All warranty claims should be directed to the manufacturer of the prize and not the Promoter. It is a condition of accepting the prize that the winner is aged 18 years or older and holds a valid Australian drivers licence. It is also a condition of accepting a prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter. Entrants consent to the Promoter using the entrant’s name, likeness, image and/or voice in the event they are a winner of a draw (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. The winners agree to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian and overseas related companies and promotional partners who may contact entrants with special offers in this way. By entering the promotion, each entrant agrees that the Promoter may use entrants’ personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media as required under the relevant lottery legislation.
